1. Introduction

This Refund and Cancellation Policy applies to all donations, contributions, membership contributions, registration contributions, participation contributions, or any other amounts paid to Swadeshi Vitta Salahkaar Parishad / Swarnim Bharatvarsh Foundation through the website, payment gateway, payment link, offline method, or any other authorized mode.

By making any payment/donation/contribution, you agree to this Refund and Cancellation Policy.

2. Founding Charter Prevails

The Founding Charter of Swadeshi Vitta Salahkaar Parishad is the main governing document for the nature of participation, contribution, rights, authority, and non-refundability.

As stated in the spirit and terms of the Founding Charter, all amounts paid to the Parishad, whether described as membership fee, registration, subscription, contribution, donation, or otherwise, are voluntary donations/contributions towards the objectives and cause of the Parishad/Foundation.

Such amounts are not consideration for any guaranteed service, right, entitlement, office, benefit, voting right, management right, proprietary right, business opportunity, or claim.

3. Current Contribution Options

The current contribution options may include:

  • Yearly Contribution: ₹1,000 for 1 year validity/access period
  • 10-Year Contribution: ₹5,000 for 10 years validity/access period

These contribution options may support access to digital platform features and participation-related activities for the relevant period, subject to approval, platform rules, continued compliance, and the governing documents of the Parishad/Foundation.

The contribution options, amounts, validity, benefits, and access conditions may be changed by the Parishad/Foundation at any time.

4. PAN Requirement

PAN shall be mandatory for donations/contributions above ₹2,000.

For donations/contributions of ₹2,000 or below, PAN may not be mandatory unless required by applicable law, internal compliance, payment verification, accounting, audit, or receipt issuance requirements.

If PAN or required donor details are not provided where required, the organization may hold, reject, reverse, refund, or decline to accept the donation/contribution.

5. Indian Citizens and NRIs Only

The donation/contribution facility is currently available only to Indian citizens, including Indian citizens residing in India and Indian citizens residing outside India as NRIs.

By making a donation/contribution, the user confirms that they are an Indian citizen.

NRI users may be required to provide additional confirmation, declaration, or documents to verify citizenship, source of funds, country of residence, payment details, or compliance requirements.

6. Foreign Contributions and FCRA Compliance

Swarnim Bharatvarsh Foundation / Swadeshi Vitta Salahkaar Parishad is not presently registered under FCRA for accepting foreign contributions.

Therefore, donations/contributions from foreign citizens, foreign entities, foreign companies, foreign trusts, foreign associations, foreign foundations, or any other foreign source are not permitted and shall not be accepted.

Foreign payments must be blocked at the payment/platform level wherever technically possible.

If any foreign-source payment is received due to payment gateway, banking, technical, or user-side error, the organization reserves the right to hold, reject, reverse, or refund such amount after verification and compliance review.

No foreign-source contribution shall be treated as accepted merely because a payment attempt was made or temporarily processed.

7. No Refund Policy

All donations/contributions are final and non-refundable.

No refund shall be provided for:

  • Change of mind
  • Accidental contribution/payment
  • Non-use of platform
  • Partial use of platform
  • Non-attendance of events
  • Non-participation in activities
  • Dissatisfaction with opportunities or networking outcomes
  • Failure to obtain referrals, business, clients, income, recognition, partnerships, or collaborations
  • Account deactivation requested by the user
  • Removal or restriction of profile visibility
  • Suspension or termination for policy violation
  • Rejection, delay, or review of profile due to incorrect, incomplete, misleading, or inappropriate information
  • Manual renewal not completed
  • User's inability to access platform due to incorrect details, forgotten credentials, or user-side issues
  • Discontinuation or change of any platform feature
  • Any reason not expressly approved by the Parishad/Foundation in writing

8. Contributions Are Not Service Fees

Users understand and agree that donations/contributions made to the Parishad/Foundation are towards the objectives, mission, and activities of the Parishad/Foundation.

They are not fees charged in exchange for guaranteed commercial services, business outcomes, rights, office, authority, membership rights, voting rights, management rights, proprietary rights, or any specific benefit.

Digital access, member directory, opportunity exchange, events, networking features, and dashboard access are facilitation features and may be modified, restricted, suspended, or withdrawn as per the rules and discretion of the Parishad/Foundation.

9. Compliance-Based Rejection, Reversal, or Refund

Although donations/contributions are generally non-refundable, the organization may reject, reverse, hold, or refund a contribution in cases where:

  • The contribution is from a foreign citizen, foreign entity, or any foreign source;
  • The contribution cannot be accepted due to FCRA restrictions;
  • Required PAN is not provided for donations/contributions above ₹2,000;
  • Donor details, citizenship confirmation, payment details, or receipt information are incomplete or incorrect;
  • NRI/citizenship/source of funds verification is not satisfied;
  • Banking, tax, audit, legal, or compliance requirements prevent acceptance;
  • A duplicate payment or verified technical payment error occurs;
  • The organization is required to reverse or refund the amount under applicable law;
  • The organization decides, at its sole discretion, not to accept the contribution.

Such refund, reversal, rejection, or hold shall not create any general refund right for other donations/contributions.

10. Duplicate Payment or Technical Error

A refund may be considered only in exceptional cases where:

  • A duplicate payment has been received for the same user and same contribution option, or
  • A payment was deducted due to a verified technical/payment gateway error, or
  • A refund is mandatorily required under applicable law, or
  • The Parishad/Foundation approves a refund in writing at its sole discretion.

To raise such a request, the user must contact us with:

  • Full name
  • Registered email/mobile number
  • Contribution amount
  • Payment date
  • Transaction ID
  • Payment screenshot or receipt
  • Bank/payment gateway reference number
  • Description of issue

If approved, refunds may be processed to the original payment method or any method permitted by the payment gateway/bank. Processing timelines may depend on banks, payment gateways, and financial institutions.

11. Receipt and Tax Treatment

A receipt or payment confirmation may be issued after successful confirmation of donation/contribution.

As the amounts are treated as donations/contributions and not consideration for supply of commercial services, GST is not presently charged on such donations/contributions.

Taxes, reporting, receipt format, and applicable treatment shall be handled as per applicable law and the receipt/payment confirmation issued by the organization.

Users/contributors should consult their own tax advisors regarding any personal or organizational tax treatment.

12. Manual Renewal and Expiry

Renewal is currently manual and not automatic.

If the validity/access period expires and the user does not make a fresh donation/contribution or complete the renewal process, the Parishad/Foundation may restrict, suspend, or deactivate access to the platform, member directory, dashboard, opportunity exchange, or other features.

Non-renewal does not create any refund right for past donations/contributions.

13. Cancellation / Deactivation by User

A user may request account deactivation or removal/restriction of profile visibility by contacting office@swadeshivitta.com.

Upon receiving a valid request, the Parishad/Foundation may deactivate login access and remove or restrict profile visibility.

However, cancellation/deactivation does not entitle the user to any refund of donation/contribution already made.

The Parishad/Foundation may continue retaining contribution records, receipts, payment details, audit logs, legal records, compliance records, moderation history, and security records as required.

14. Suspension or Termination by Parishad/Foundation

The Parishad/Foundation may suspend, restrict, deactivate, or terminate any account, profile, access, listing, post, designation, participation, or feature without refund if:

  • The user violates the Founding Charter
  • The user violates the Code of Conduct
  • The user violates the Terms and Conditions
  • The user provides false, incomplete, or misleading information
  • The user misuses member data or contact information
  • The user posts unlawful, inappropriate, or misleading content
  • The user engages in spam, fraud, harassment, abuse, or illegal activity
  • The user acts against the objectives, values, dignity, reputation, or functioning of the Parishad/Foundation
  • Legal, governance, compliance, or security requirements require such action

15. Events, Networking, and Opportunities

Participation may include access to events, networking, member directory, opportunity exchange, community activities, or other features.

No refund shall be provided merely because:

  • A user does not attend an event
  • A user does not receive desired networking benefit
  • A user does not receive business/referrals
  • A user does not find suitable opportunities
  • An opportunity does not result in any outcome
  • An event, feature, or activity is rescheduled, changed, restricted, or discontinued

16. Payment Gateway and Bank Charges

Payment gateway charges, bank charges, convenience fees, processing fees, or transaction charges, if any, may not be refundable unless required by applicable law or permitted by the relevant payment gateway/bank.
