1. Introduction

These Terms and Conditions govern your access to and use of the Swadeshi Vitta website, digital platform, member dashboard, directory, opportunity exchange, chapter/community features, event-related features, communication tools, donation/contribution flow, and related services.

Swadeshi Vitta Salahkaar Parishad, also referred to as "SVSP", "the Parishad", "we", "us", or "our", is a unit of Swarnim Bharatvarsh Foundation, a Section 8 Company. The Parishad functions under and is governed by the rules, regulations, charter documents, directions, and authority of Swarnim Bharatvarsh Foundation.

By accessing the website, creating an account, submitting information, making any donation/contribution, creating posts, uploading documents, participating in activities, or using any feature of the platform, you agree to these Terms and Conditions.

If you do not agree with these Terms, you should not use the website or platform.

2. Founding Charter as Governing Document

The Founding Charter of Swadeshi Vitta Salahkaar Parishad is the primary document governing the nature, purpose, participation, authority, membership, rights, contribution, conduct, and structure of the Parishad.

These Terms and Conditions are intended to support and operationalize the digital platform and related website features. They do not replace or override the Founding Charter or the governing documents of Swarnim Bharatvarsh Foundation.

In case of any inconsistency between these Terms and the Founding Charter regarding the nature of participation, contribution/donation, rights, authority, governance, or member status, the Founding Charter and governing documents of Swarnim Bharatvarsh Foundation shall prevail.

3. About the Parishad and Platform

Swadeshi Vitta Salahkaar Parishad is a national professional body for financial advisors, accountants, auditors, tax consultants, bankers, company secretaries, cost accountants, economists, academicians, policy professionals, lawyers, firms, students, and allied professionals who subscribe to the values and objectives of the Parishad.

The platform may provide digital features including:

  • Account creation and login
  • Profile and participation form
  • Donation/contribution payment flow
  • Member/contributor approval and verification
  • Member dashboard
  • Logged-in member directory
  • Opportunity exchange
  • Chapter/community features
  • Event and networking access
  • Admin review and moderation
  • Donation/contribution tracking
  • Communication and support features

4. Eligibility

The website and platform are intended only for users who are 18 years of age or above. Users below 18 years of age are not permitted to create an account, submit personal data, make donations/contributions, upload documents, access the member dashboard, post opportunities, or use the platform.

The platform and donation/contribution facility are currently available only to Indian citizens, including Indian citizens residing in India and Indian citizens residing outside India as NRIs.

By creating an account, submitting information, making a donation/contribution, or using the platform, you confirm that:

  • You are 18 years of age or above;
  • You are an Indian citizen;
  • The information provided by you is true, correct, and complete;
  • You are legally permitted to use the platform and make the donation/contribution;
  • Where you are acting on behalf of a firm, company, or organization, you are authorized or otherwise permitted to do so.

5. NRI Users

Indian citizens residing outside India may register or contribute as NRIs, subject to applicable laws, banking rules, payment gateway rules, and internal verification.

NRI users may be required to provide additional confirmation, declaration, or documents to verify citizenship, source of funds, country of residence, payment details, or compliance requirements.

The organization reserves the right to hold, reject, reverse, or refund any contribution where citizenship, source of funds, banking compliance, legal compliance, or internal verification is not satisfied.

6. Foreign Contributions and FCRA Compliance

Swarnim Bharatvarsh Foundation / Swadeshi Vitta Salahkaar Parishad is not presently registered under FCRA for accepting foreign contributions.

Therefore, donations/contributions from foreign citizens, foreign entities, foreign companies, foreign trusts, foreign associations, foreign foundations, or any other foreign source are not permitted and shall not be accepted.

Foreign payments must be blocked at the payment/platform level wherever technically possible.

If any foreign-source payment is received due to payment gateway, banking, technical, or user-side error, the organization reserves the right to hold, reject, reverse, or refund such amount after verification and compliance review.

No foreign-source contribution shall be treated as accepted merely because a payment attempt was made or temporarily processed.

7. Voluntary Participation

Participation in the Parishad is voluntary and honorary in nature. Every member, contributor, office-bearer, representative, or participant joins and participates in furtherance of the objectives of the Parishad and the cause of nation-building, professional excellence, Swadeshi thought, financial literacy, entrepreneurship, policy engagement, and service to society and the economy.

Participation does not create any personal right, office, authority, guaranteed benefit, commercial entitlement, ownership, claim, or control over the Parishad or Swarnim Bharatvarsh Foundation.

8. Donations / Contributions, Not Service Fees

All amounts paid to the Parishad/Foundation through the website, payment gateway, offline method, or any authorized mode, whether described as membership contribution, registration contribution, subscription, membership amount, participation amount, donation, contribution, or by any other name, shall be treated as voluntary donation/contribution towards the objectives and cause of the Parishad/Foundation.

Such amounts are not consideration for any guaranteed service, right, entitlement, office, authority, voting right, management right, proprietary right, business benefit, referral, opportunity, or outcome.

All such donations/contributions are non-refundable, except where a refund is mandatorily required by applicable law or where a duplicate/technical payment error or compliance issue is verified and approved by the Parishad/Foundation.

9. Current Contribution Options

The current contribution options displayed on the platform may include:

  • Yearly Contribution: ₹1,000 for 1 year validity/access period
  • 10-Year Contribution: ₹5,000 for 10 years validity/access period

These amounts support participation and access to applicable platform features for the relevant period, subject to approval, platform rules, the Founding Charter, and continued compliance with these Terms.

The above amounts may be changed, withdrawn, revised, or restructured by the Parishad/Foundation at any time.

10. PAN Requirement

Since donation/contribution receipts may be issued by the organization, PAN shall be mandatory for donations/contributions above ₹2,000.

For donations/contributions of ₹2,000 or below, PAN may not be mandatory unless required by applicable law, internal compliance, payment verification, accounting, audit, or receipt issuance requirements.

If required PAN or donor details are not provided, the organization may hold, reject, reverse, refund, or decline to accept the donation/contribution.

11. Tax and GST Clarification

Amounts paid to the Parishad/Foundation are treated as donations/contributions towards the objectives and cause of the organization and not as consideration for supply of a commercial service.

Accordingly, GST is not presently charged on such donations/contributions. However, tax treatment, reporting, receipt format, donor information, and compliance requirements shall be handled in accordance with applicable law and the receipt/payment confirmation issued by the organization.

Users and contributors should consult their own tax advisors regarding eligibility, deduction, reporting, or treatment of any donation/contribution.

12. Receipts

After successful confirmation of payment/contribution, a receipt or payment confirmation may be issued by the organization or through the payment gateway/platform.

Issuance of receipt does not create any right, entitlement, ownership, office, management authority, voting right, guaranteed service, or refund claim.

13. Manual Renewal

Contribution/membership validity is currently renewed manually.

There is no automatic renewal at present. Users who wish to continue their participation or platform access after expiry must make a fresh donation/contribution or complete any renewal process prescribed by the Parishad/Foundation.

Failure to renew may result in expiry, suspension, restriction, or deactivation of platform access.

14. Account Registration

Users may sign up through email and password or any other authentication method enabled by the platform.

After sign-up, users may be required to fill a form with details such as:

  • Name
  • Contact details
  • City/state
  • Organization/company/firm
  • Profession
  • Industry
  • Experience
  • Expertise
  • Designation
  • Social/contact links
  • Citizenship confirmation
  • NRI status, where applicable
  • PAN where required
  • Optional documents
  • Any other required profile or participation details

All users may currently sign up as individual users. If a user signs up on behalf of a firm, company, organization, or professional body, the user confirms that they are authorized or otherwise permitted to submit information and participate on its behalf.

15. Membership / Participation Approval

Submission of a form or donation/contribution does not guarantee final acceptance, approval, continued access, listing, designation, role, event participation, or any specific benefit.

The Parishad/Foundation may approve, reject, hold, review, suspend, reactivate, or terminate any account, profile, membership, contributor status, or platform access at its discretion.

Approval may be automatic after payment confirmation or may be subject to manual admin review, verification, and internal approval.

The Parishad/Foundation may request additional information, review documents, add internal remarks, or take appropriate action to preserve trust, integrity, compliance, and the objectives of the Parishad.

16. No Rights of Any Kind

By signing up, contributing, donating, participating, being listed, receiving a badge, being called a member, or being given any designation, you do not receive:

  • Voting rights
  • Management rights
  • Ownership rights
  • Proprietary rights
  • Rights over assets or funds
  • Rights over decisions or affairs
  • Office or position rights
  • Authority to bind the Parishad/Foundation
  • Guaranteed business benefits
  • Guaranteed referrals
  • Guaranteed opportunities
  • Guaranteed event access
  • Guaranteed consultation
  • Guaranteed platform access for all time
  • Any claim against the Parishad/Foundation beyond what is expressly permitted in writing

All rights, authority, and control over the Parishad vest in Swarnim Bharatvarsh Foundation and its authorized governing structure.

17. Designations and Roles

Any designation, badge, category, role, title, founding status, core member status, professional member status, corporate representative status, student member status, office-bearer label, committee role, or coordinator role is for identification, reference, coordination, or administrative purposes only.

Such designation does not create ownership, management control, voting right, employment, agency, partnership, office right, proprietary interest, or any binding authority unless expressly authorized in writing by the competent authority of the Foundation/Parishad.

18. Platform Access and Features

The platform may provide access to:

  • Member dashboard
  • Member profile
  • Logged-in member directory
  • Opportunity exchange
  • Chapter/community features
  • Events and networking features
  • Donation/contribution records
  • Profile visibility
  • Communication features
  • Other digital features enabled from time to time

These features are facilitation tools only. They do not guarantee business, income, clients, referrals, partnerships, appointments, policy access, event participation, recognition, certification, or professional outcomes.

The Parishad/Foundation may add, modify, restrict, suspend, or discontinue any feature at any time.

19. Member Directory and Contact Use

Approved profiles may be visible to logged-in members/users of the platform. Members may see certain details such as name, company/firm, profession, designation, expertise, city/state, chapter affiliation, social links, and contact details, subject to platform settings.

Users must not misuse member contact details for spam, harassment, unsolicited bulk communication, political misuse, commercial exploitation, illegal activity, scraping, data resale, or any purpose inconsistent with the objectives of the Parishad.

20. Opportunity Exchange

Members/users may post:

  • Collaboration requests
  • Referral opportunities
  • Expertise requirements
  • City-specific support requests
  • Professional assistance requests
  • Other opportunity-related posts permitted by the platform

Opportunity posts are intended for logged-in member dashboard visibility only, unless otherwise enabled by the Parishad/Foundation.

Users are solely responsible for the accuracy, legality, appropriateness, and consequences of their posts.

The Parishad/Foundation does not verify or guarantee the authenticity, legality, commercial value, quality, outcome, or reliability of opportunities posted by users. Users must conduct their own due diligence before acting on any post, opportunity, referral, collaboration, contact, or proposal.

21. Prohibited Content and Conduct

You must not post, upload, share, or transmit content that is:

  • False, misleading, fraudulent, or deceptive
  • Illegal or promoting illegal activity
  • Defamatory, abusive, threatening, obscene, hateful, or discriminatory
  • Contrary to the values and dignity of the Parishad
  • Infringing intellectual property or privacy rights
  • Confidential information shared without authorization
  • Spam, mass solicitation, or unrelated promotional material
  • Harmful to public order, national interest, or applicable law
  • Harmful to the platform, members, Parishad, Foundation, or its reputation
  • Malware, harmful code, or technically abusive content
  • Otherwise inappropriate in the discretion of the Parishad/Foundation

22. Admin Rights and Moderation

The Parishad/Foundation and its authorized administrators may:

  • Review user profiles
  • Approve or reject applications
  • Suspend or reactivate accounts
  • Remove, edit, hide, or restrict posts
  • Remove inappropriate or flagged content
  • Restrict access to features
  • Verify payment/contribution status
  • Maintain transaction and contribution records
  • Review uploaded documents
  • Issue warnings
  • Deactivate or terminate accounts
  • Take action for violations of the Founding Charter, policies, or law

Moderation decisions may be taken without prior notice where necessary for trust, safety, compliance, governance, or protection of the Parishad/Foundation.

23. Code of Conduct

Every user/member/contributor is expected to follow the values and conduct reflected in the Founding Charter, including:

  • Integrity and ethics
  • Honesty and professional independence
  • Nation-first and public-interest approach
  • Respect for every member without discrimination
  • Confidentiality
  • Avoidance of conflicts of interest
  • Lawful conduct
  • Professional excellence
  • Transparency and accountability
  • Service to society and the economy
  • Promotion of Swadeshi thought, financial literacy, entrepreneurship, and inclusive growth

Violation of the Code of Conduct may lead to moderation, suspension, deactivation, termination, removal of visibility, or other action.

24. Confidentiality

Users must maintain confidentiality of:

  • Internal documents
  • Member-only information
  • Opportunity posts
  • Contact details
  • Internal communications
  • Committee discussions
  • Event-related restricted information
  • Any information marked confidential or shared for limited circulation

Users must not reproduce, circulate, publish, sell, scrape, or misuse such information without authorization.

25. Uploaded Documents

If you upload professional proof, company documents, certificates, visiting cards, profile images, or other files, you confirm that:

  • You have the right to upload them
  • The information is genuine and accurate
  • The upload does not violate third-party rights
  • The documents do not contain unlawful material
  • The upload is not misleading or fraudulent

The Parishad/Foundation may review, reject, remove, or restrict uploaded documents at its discretion.

26. Intellectual Property

All website content, brand elements, platform design, text, graphics, logos, software, layouts, documents, and materials made available by the Parishad/Foundation are owned by or licensed to the Parishad/Foundation or respective owners.

You may not copy, reproduce, modify, distribute, publish, exploit, or create derivative works from our content without written permission.

You retain ownership of content submitted by you, such as profile information and posts. However, by submitting content, you grant the Parishad/Foundation a non-exclusive, royalty-free, worldwide license to use, store, display, process, moderate, reproduce, and manage such content for operating, promoting, securing, preserving, and improving the platform and activities of the Parishad/Foundation.

27. No Professional, Financial, Legal, Tax, or Investment Advice

The platform is primarily a professional networking, participation, and community platform.

Unless expressly stated in writing by an authorized representative, no content on the platform should be treated as financial, legal, tax, investment, regulatory, business, or professional advice from the Parishad/Foundation.

Users should take independent professional advice before acting on any content, opportunity, referral, member communication, event, or post.

28. Third-Party Services

The platform may use third-party services such as payment gateways, hosting providers, cloud storage, email/SMS/WhatsApp tools, analytics tools, event platforms, and external links.

The Parishad/Foundation is not responsible for third-party downtime, errors, policies, security, payment delays, or service failures.

29. Platform Availability

We aim to maintain platform availability, but we do not guarantee uninterrupted or error-free access.

The platform may be unavailable due to maintenance, upgrades, technical issues, internet failures, payment gateway downtime, cyber incidents, legal requirements, or events beyond our control.

30. Limitation of Liability

To the maximum extent permitted by law, the Parishad, Swarnim Bharatvarsh Foundation, office-bearers, coordinators, administrators, representatives, and service providers shall not be liable for any direct, indirect, incidental, consequential, business, reputational, financial, data-related, or other loss arising from:

  • Use or inability to use the platform
  • Approval, rejection, suspension, or termination of access
  • Donations/contributions
  • Non-refund of donations/contributions
  • Member interactions
  • Opportunity posts
  • Failed business outcomes
  • Payment gateway issues
  • Third-party services
  • Unauthorized access
  • Technical errors
  • Downtime
  • Loss of data
  • Misuse by other users
  • Any content posted by members/users

31. Indemnity

You agree to indemnify and hold harmless Swadeshi Vitta Salahkaar Parishad, Swarnim Bharatvarsh Foundation, its office-bearers, administrators, coordinators, representatives, employees, volunteers, advisors, and service providers from claims, losses, liabilities, damages, costs, or expenses arising out of:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of the Founding Charter or Code of Conduct
  • Your submitted content or documents
  • Your misuse of member data
  • Your interaction with other members
  • Your violation of law
  • Your infringement of third-party rights
  • False, misleading, or unauthorized information submitted by you

32. Account Suspension and Termination

The Parishad/Foundation may suspend, restrict, deactivate, or terminate your account, profile, visibility, access, or participation without refund if:

  • You violate these Terms
  • You violate the Founding Charter or Code of Conduct
  • You submit false or misleading information
  • You misuse member data
  • You post inappropriate or unlawful content
  • You engage in spam, fraud, harassment, or illegal activity
  • You harm the platform, members, Parishad, Foundation, or its reputation
  • Required donation/contribution is not completed or confirmed
  • Required PAN is not provided for donations/contributions above ₹2,000
  • Citizenship, NRI, FCRA, banking, or compliance verification fails
  • Governance or compliance requirements require such action

Upon deactivation or termination, profile visibility may be removed or restricted, but payment, contribution, receipt, audit, legal, compliance, and security records may be retained.

33. Grievance Officer and Contact Details

Users may contact the designated Grievance Officer for complaints, privacy-related concerns, data correction/deletion requests, content-related complaints, platform misuse, payment/contribution issues, or any other grievance.

34. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on the website with a revised effective date.

Continued use of the platform after updates means that you accept the revised Terms.

35. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes arising out of or relating to the website, platform, donation/contribution, participation, membership, access, posts, policies, or these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.
